5.1 PURPOSE

(a) The purpose of this provision is to demonstrate the commitment of the Company to consistently provide Safe, Quality and environmentally sound services that can meet customer and comply with all mandatory rules and regulations, as applicable.

(b) This Chapter establishes a procedure for identifying and having access to legal and other requirements by relevant Interested Parties which are directly related to the aspects of all activities.

5.1.1 Requirements of Relevant Interested Parties

Due to their effect or potential effect on Company’s ability to consistently provide Safe, Quality and environmentally sound services, and to meet customer and applicable statutory, code of practice, relevant maritime laws and regulatory requirements.

5.2 SCOPE

This procedure is applicable to all activities and services of Company and fleet vessels.

5.3 RESPONSIBILITY AND AUTHORITY

a) The DPA shall have the overall responsibility for tracking and receiving the latest applicable laws and regulations and identifying those related to the operations of the Company with active support of Technical and Marine Groups. These are then conveyed to relevant operating groups.

b) Meeting compliance obligations and each department is the responsibility of the group GM.

c) HR/ GM local in charge shall be responsible for verifying compliance with local regulations within the office complex.

5.4 MANDATORY RULES & REGULATIONS – GENERAL

a) Due attention shall be paid to instructions and guidance issued by international and national bodies aimed at ensuring safe ship operation and pollution prevention.

b) The Company will ensure that all the required publications are available on-board vessels as per Flag or other statutory requirements.

c) The Company employs a variety of techniques and information sources to regularly track, identify and evaluate applicable laws and regulations. These include, but are not limited to:

    • Classification Society circulars

    • Flag State Circulars

    • Commercial services and databases;

    • Regulatory agencies (federal, state, and local)

    • Trade groups and associations

    • Internet

    • Consultants and attorneys

    • Newsletters and magazines

    • Information made available and provided by trade associations and membership organizations

d) The Company shall comply with all Safety, Quality and Environmental requirements established under applicable and port state law, including, but not limited to:

    i) International Conventions and Codes

    ii) Flag State Laws

    iii) Local regulations

    iv) International Standards

5.5 TECHNICAL LIBRARY

a) The Company has a policy of maintaining a library ashore and on board the vessels for all required relevant mandatory rules and regulations.

b) A muster list shall be prepared by the Master on board and the DP ashore which states holder, location and version no. for such documents. The DP is responsible for keeping the shore-based library updated.

5.6 INTERESTED PARTIES

a) The Company has identified the following interested parties and their requirements relevant to the SQEMS.

i) Government & Community - Environmental protection/Ethical behavior/growth in business and taxes to build infrastructure to support community services, activities, and institutions.

        • Local and National Government units, etc.

ii) Statutory and Regulatory Bodies - Compliance with applicable requirements and industry standards/submission of reports.

        • IMO

        • Flag States

        • Classification Societies

        • Port State Control

        • Local Regulatory bodies of countries where ships are calling

        • JSU

        • OCIMF

        • P&I Club, Insurers, etc.

iii) Customers – Quality delivery and services, Profitability/return on investment/growth in market value of organization. Refer to SQEM-07-00 Customer Focus and Requirements

        • Owners

        • Charters

iv) Management - Increased growth, sales & profitability/efficiency & effectiveness of operations

v) Employees/Crew - not only interested parties, employees are intimately involved in how well SQEMS performs. Good work environment/job security/health/safety/training/promotion, recognition and reward.

vi) External providers of product and services (suppliers; partners, Vendors, Workshops, Dry Docks, Manning offices) - Increase scope and volume of purchases/long-term contractual arrangements/information on future requirements. Product/service feedback; insight on future needs and technical support.

5.6.1 Needs and Expectations of Interested Parties

a) The Company will monitor and review the information of all interested parties and management on the relevant needs and expectations of interested parties, the process of how to determine if these needs and expectations to become its compliance obligation were not clearly defined on documented information.

b) Evaluation of the needs and expectations of Interested parties which are to become Company’s compliance obligation will be conducted in Management Reviews under applicable sections.
